India Muslim Personal Law Board (AIMPLB) has strongly opposed the so-called Uniform Civil Code (UCC) recently passed by the Gujarat Legislative Assembly and earlier implemented in Uttarakhand, describing it as constitutionally flawed, legally untenable, and fundamentally violative of religious freedom and civil liberties.Addressing the media in New Delhi, senior representatives of the Board said that the Gujarat UCC Bill, currently awaiting the Governor\u2019s assent, has raised grave constitutional, legal, and democratic concerns among citizens across the country. The Board stated that the legislation, despite being labelled as a \u201cUniform Civil Code,\u201d does not conform to the constitutional spirit and directly infringes upon the fundamental rights guaranteed under Part III of the Constitution, including the rights to religious freedom, equality, and personal liberty.The Board underlined that the UCC is mentioned under Article 44 in Part IV of the Constitution as a Directive Principle of State Policy, which is not directly enforceable like fundamental rights. It stressed that any such code, in its true constitutional sense, must be uniformly applicable to all citizens throughout the country. However, the Gujarat law, the Board pointed out, neither applies nationwide nor uniformly within the State itself, as Scheduled Tribes and other constitutionally protected communities have been exempted.\u201cThis legislation cannot be described as a genuine Uniform Civil Code. The nomenclature itself is misleading and deceptive,\u201d the Board said.Referring to the debates of the Constituent Assembly, the Board recalled that Dr. B. R. Ambedkar had clearly assured that no such law would be imposed upon citizens without public consent. It also noted that both the 21st and 22nd Law Commissions had sought public opinion on the issue, and that the AIMPLB had formally submitted its opposition and written arguments before the 21st Law Commission. The Commission had subsequently observed that, under prevailing circumstances, a UCC was neither necessary nor desirable.The Board further expressed serious concern over the opacity surrounding the consultative process undertaken by the Gujarat Government. It stated that although a committee was constituted to seek public feedback, the report has not been made public, despite widespread opposition to the proposal.\u201cThis raises serious questions about transparency and suggests that the consultative exercise was merely a procedural formality rather than a genuine democratic process,\u201d the statement said.The Board also termed the law an attempt to impose majoritarian social and cultural norms upon minority communities, particularly Muslims. It argued that issues such as marriage, divorce, inheritance, succession, and family law are integral to Islamic jurisprudence and religious practice, and any state interference in these matters violates the constitutionally guaranteed right to religious freedom.According to the Board, several provisions rooted in Islamic personal law have been either criminalised or rendered legally invalid under the new code, while alternative frameworks based on majoritarian customs are being imposed.The AIMPLB informed the media that the Uttarakhand UCC has already been challenged before the High Court by the Board and several religious organisations, where the matter is currently sub judice.Expressing concern over the timing of the legislation, the Board said the move appears to be politically motivated, particularly in view of upcoming elections in several states and municipal polls in Gujarat.\u201cThe timing of this legislation gives rise to a reasonable apprehension that constitutional law-making is being subordinated to electoral considerations and political expediency,\u201d the statement observed.The Board has demanded an immediate halt to the implementation of the UCC in both Uttarakhand and Gujarat, and called for a comprehensive constitutional review.
