وندے ماترم کو لازمی قرار دینا بنیادی حقوق اور سپریم کورٹ کے فیصلے کی خلاف ورزی ہے: آل انڈیا مسلم پرسنل لا بورڈ

آل انڈیا مسلم پرسنل لا بورڈ نے مغربی بنگال حکومت کی جانب سے ریاست کے سرکاری اسکولوں اور سرکار سے تسلیم شدہ دینی مدارس میں طلبا و طالبات کے لیے صبح کی اسمبلی میں وندے ماترم کے تمام بندوں کی قرأت کو لازمی قرار دینے کے فیصلے پر شدید تشویش کا اظہار کرتے ہوئے مطالبہ کیا ہے کہ اس نوٹیفکیشن کو فوری طور پر واپس لیا جائے، یا کم از کم مسلم طلبا و طالبات کو اس سے مستثنیٰ قرار دیا جائے۔بورڈ کے ترجمان ڈاکٹر سید قاسم رسول الیاس نے ایک پریس بیان میں کہا کہ کسی بھی طالب علم کو اس کے مذہبی عقائد کے خلاف کوئی کلمہ یا نغمہ پڑھنے پر مجبور کرنا نہ صرف دستور ہند کے بنیادی حقوق، بالخصوص آرٹیکل 19، 25 اور 28(3) کی صریح خلاف ورزی ہے بلکہ سپریم کورٹ کے تاریخی فیصلے Bijoe Emmanuel v. State of Kerala کے بھی منافی ہے، جس میں عدالت عظمیٰ نے واضح کیا تھا کہ کسی شہری کو اس کے مذہبی یا ضمیری عقائد کے خلاف کسی قومی یا مذہبی نوعیت کی تقریب میں شرکت پر مجبور نہیں کیا جا سکتا۔ڈاکٹر الیاس نے کہا کہ مسلم پرسنل لا بورڈ یہ واضح کرنا ضروری سمجھتا ہے کہ وندے ماترم کے بعض بند ایسے تصورات پر مشتمل ہیں جنہیں مسلمان اپنے عقیدۂ توحید کے منافی سمجھتے ہیں۔ اس لیے کسی مسلمان طالب علم کو اسے پڑھنے پر مجبور کرنا اس کے مذہبی تشخص اور دستوری حقوق پر براہِ راست حملہ ہے۔ انہوں نے کہا کہ سیکولر ریاست کا تقاضا یہ ہے کہ وہ کسی ایک مذہبی یا ثقافتی روایت کو دوسرے مذہبی گروہوں پر زبردستی مسلط نہ کرے۔انہوں نے مزید کہا کہ آزادی کے بعد سے آج تک حکومت ہند نے بھی وندے ماترم کو ملک کے تعلیمی اداروں میں لازمی قرار نہیں دیا۔ یہی وجہ ہے کہ اس مسئلے کو ہمیشہ شہریوں کے ضمیر، مذہبی آزادی اور شخصی انتخاب کے دائرے میں رکھا گیا ہے۔ڈاکٹر الیاس نے دستور ہند کی دفعہ 28(3) کا حوالہ دیتے ہوئے کہا کہ ریاست کے زیر انتظام یا ریاستی امداد یافتہ تعلیمی اداروں میں کسی بھی طالب علم کو مذہبی تعلیم حاصل کرنے یا کسی مذہبی عبادت یا مذہبی نوعیت کی تقریب میں شرکت پر مجبور نہیں کیا جا سکتا، جب تک کہ اس کی آزادانہ رضامندی شامل نہ ہو۔ لہٰذا ریاستی حکومت کا یہ فیصلہ نہ صرف آئینی روح کے خلاف ہے بلکہ ملک کی سیکولر اور جمہوری روایات سے بھی متصادم ہے۔آل انڈیا مسلم پرسنل لا بورڈ نے مغربی بنگال کے مسلم طلبا، والدین اور اساتذہ سے اپیل کی ہے کہ وہ اپنے دستوری اور قانونی حقوق سے آگاہ رہیں اور اگر کسی بھی سطح پر انہیں جبر یا دباؤ کے ذریعے وندے ماترم پڑھنے پر مجبور کیا جائے تو وہ دستور ہند کے بنیادی حقوق اور سپریم کورٹ کے مذکورہ فیصلے کی بنیاد پر قانونی چارہ جوئی کریں۔بورڈ نے مغربی بنگال حکومت کو متنبہ کیا ہے کہ وہ ریاست کے تمام شہریوں کے مذہبی حقوق، ثقافتی شناخت اور دستوری آزادیوں کا احترام کرے۔ ہندوستان ایک سیکولر اور کثرت پسند جمہوریہ ہے جہاں ہر مذہبی گروہ کو اپنے عقائد کے مطابق زندگی گزارنے اور اپنی مذہبی شناخت برقرار رکھنے کا مکمل حق حاصل ہے۔ کسی بھی سرکاری اقدام کو اس بنیادی اصول کو مجروح کرنے کی اجازت نہیں دی جا سکتی۔جاری کردہ:ڈاکٹر وقار الدین لطیفیآفس سکریٹری آل انڈیا مسلم پرسنل لا———————————————————–PRESS RELEASEMaking Vande Mataram Compulsory Violates Fundamental Rights and Supreme Court Precedent:All India Muslim Personal Law BoardNew Delhi, June 2, 2026The All India Muslim Personal Law Board (AIMPLB) has expressed deep concern over the decision of the Government of West Bengal to make the recitation of all stanzas of Vande Mataram compulsory during morning assemblies in government schools and government-recognized madrasas across the state. The Board has demanded that the notification be withdrawn immediately or, at the very least, that Muslim students be exempted from its application.In a press statement, the Board’s spokesperson, Dr. S. Q. R. Ilyas, said that compelling any student to recite a song or text that is contrary to his or her religious beliefs constitutes a clear violation of the Fundamental Rights guaranteed under the Constitution of India, particularly Articles 19, 25, and 28(3). He further stated that such a directive is inconsistent with the Supreme Court’s landmark judgment in Bijoe Emmanuel v. State of Kerala, wherein the Court categorically held that no citizen can be compelled to participate in a national or religious ceremony in violation of sincerely held religious or conscientious beliefs.Dr. Ilyas said that the Muslim Personal Law Board considers it necessary to clarify that certain stanzas of Vande Mataramcontain concepts that Muslims regard as inconsistent with the Islamic doctrine of monotheism (Tawhid). Therefore, forcing Muslim students to recite the song amounts to a direct infringement upon their religious identity and constitutional freedoms. He emphasized that a secular state must not impose the religious or cultural traditions of one community upon another.He further noted that since Independence, the Government of India has never made the recitation of Vande Mataramcompulsory in educational institutions. For this reason, the matter has historically been treated as one of individual conscience, religious liberty, and personal choice.Referring to Article 28(3) of the Constitution, Dr. Ilyas pointed out that no student attending an educational institution maintained by the State or receiving State aid can be compelled to participate in religious instruction, worship, or religious observances without his or her free consent. Consequently, the West Bengal Government’s decision is not only contrary to the spirit of the Constitution but also inconsistent with India’s secular and democratic traditions.The All India Muslim Personal Law Board has appealed to Muslim students, parents, and teachers in West Bengal to remain aware of their constitutional and legal rights. The Board has urged them to seek appropriate legal remedies if they are subjected to any form of coercion or pressure to recite Vande Mataram, relying upon the Fundamental Rights guaranteed by the Constitution and the Supreme Court’s ruling in Bijoe Emmanuel.The Board has also cautioned the Government of West Bengal to respect the religious rights, cultural identity, and constitutional freedoms of all citizens. India is a secular and pluralistic republic where every religious community enjoys the right to live in accordance with its faith and preserve its distinct religious identity.
